(A) Club Usage & Participation Terms and Conditions

1. Acceptance of Terms

  • These Terms and Conditions, the Waiver & Release Agreement, and the Privacy Policy (together, the “Terms”) govern the use and participation of any court, facility, program, lesson, clinic, recovery session, event, equipment, or other service (collectively, the “Services”) provided by Performance Pickleball, Performance Racquet Academy, Umeus, and Rejuuv (together, the “Club”, “we”, “our”, or “us”).

  • By booking a court, lesson, program, service, event, or recovery session with, or by visiting, any of the Brands, you — and, where you are the Club User/Hirer, all guests and participants under your booking — agree to uphold and be bound by these Terms in full.

  • These Terms apply across all Brands. A breach of these Terms in connection with any one Brand may result in enforcement action, including suspension or permanent account deactivation, across all Brands.

  • Entering any Club premises or participation in any service confirms that the person — and, where applicable, their guests — has read, understood, and accepted these Terms, including the Waiver & Release Agreement and Privacy Policy, whether or not that person made the booking.

  • To protect the integrity of our community, any intentional circumvention of these Terms may result in immediate account deactivation and a permanent ban from all Brands.

  • Where conduct may constitute a criminal offence, violation of law, fraud, theft, harassment, trespass, or any other unlawful activity, we reserve the right to report the matter to the relevant authorities and to cooperate fully with any investigation.

2. Definitions

  • “Club User/Hirer” means the member who makes a booking or registers for the service and is accountable for it.

  • “Participant”, “Player” or “Guest” means any individual who plays, attends, or is otherwise present on the Premises under a booking.

  • “Booking System” means the Club's official app(s) and/or website used for making bookings.

  • “Premises” means any facility operated under the Brands.

  • “Management” means the Club's management team, who hold final discretion on the interpretation and enforcement of these Terms.

  • “Brands” means Performance Pickleball, Performance Racquet Academy, Umeus and any associated brand collectively.

3. Amendment to these Terms

  • The Club reserves the right to amend, update, modify, or replace these Terms, including the Waiver & Release Agreement and Privacy Policy, and any related rules, policies, fees, operating procedures, service requirements, program terms, booking conditions, and facility guidelines at any time, at its sole discretion and without prior notice.

  • The latest version published on the Club's website or Booking System applies. Continued use of the Services after an update is published constitutes acceptance of the updated Terms.

4. Management Rights & General Enforcement

  • Management may, at its sole discretion: refuse entry; suspend, terminate, or deactivate accounts; cancel bookings; remove individuals from the Premises; deny future access; charge applicable fees; recover losses or damages; and take any other action reasonably necessary to protect the safety, integrity, operations, reputation, and fair use of the Club's facilities, programs, staff, members, and guests.

  • Enforcement action may be taken for conduct that breaches the letter or the spirit of these Terms, including conduct not expressly described in these Terms.

  • Where any ambiguity exists in the interpretation of these Terms, Management's interpretation is final and binding.

  • The Club's failure to enforce any provision on one occasion does not waive its right to enforce that provision, or any other provision, on a future occasion.

  • Where conduct may constitute a criminal offence, violation of law, fraud, theft, harassment, trespass, property damage, or any other unlawful activity, the Club reserves the right to report the matter to the relevant authorities and to cooperate fully with any resulting investigation, legal proceeding, or enforcement action.

5. Identity Integrity and Account Use

  • Each member must hold a single individual account registered in their own legal or commonly used real name, and all bookings must be made and used by that member personally.

  • Using false, fictitious, misleading, incomplete, or non-genuine identity information — including fabricated names, aliases, gibberish names, impersonation, or other inaccurate personal details — is strictly prohibited. Maintaining duplicate accounts, creating additional accounts to circumvent booking limits or eligibility requirements, or using multiple identities is also prohibited.

  • Using another person's identity, account, or booking credentials, or allowing another person to use yours ("identity-sharing"), is strictly prohibited.

  • "Account sniping" — making bookings on behalf of, or at the request of, another person in order to circumvent booking limits, waitlists, priority access, eligibility requirements, or other restrictions — is strictly prohibited.

  • Any member found to be involved in identity-sharing, account sniping, the use of false identities, or the creation or use of duplicate accounts, whether as the account holder or as the person benefiting from such conduct, may face immediate suspension or permanent deactivation of the relevant account(s) across all Brands.

  • By making a booking, you confirm that you are the person named on the account and that the account accurately reflects your identity.

6. Responsibilities of the Club User / Hirer

  • The individual making a reservation (the “Club User/Hirer”) is responsible for the conduct of all participants under that booking.

  • The Club User/Hirer must ensure that all participants and guests under their booking are aware of, and agree to comply with, these Terms and all Club policies.

  • Any breach of these Terms by a participant or guest may be treated as a breach by the Club User/Hirer, and may result in enforcement action against the Club User/Hirer's account, including suspension, deactivation, removal from the Premises, cancellation of bookings, and recovery of any losses, damages, costs, fees, or expenses incurred by the Club.

  • Entering the Club or participating in any program or services signifies that the Club User/Hirer and all guests under that booking have read and accepted these Terms, including the Waiver & Release Agreement and Privacy Policy.

7. Authorised Use of Bookings

  • All bookings — for courts, programs, lessons, equipment, recovery sessions, and facilities — are for the personal, recreational use of the Club User/Hirer and their genuine guests only.

  • Unauthorised commercial or paid sessions, including sessions organised, advertised, or facilitated through Reclub  or any similar third-party platform, are strictly prohibited. Full details are set out in Section 10.3 (Commercial Integrity Policy).

8. Program Booking Terms

  • An active account is required for all lessons, clinics, workshops, and recovery sessions.

  • Advance booking is mandatory for all programs. Walk-in participation is not permitted under any circumstances, to ensure a seamless experience for students and coaches.

  • Each program is designed with specific goals and requirements. Detailed registration processes, terms, and cancellation policies are provided on each program's dedicated page. These program-specific terms apply in addition to, and do not replace, these Terms. Participants should familiarise themselves with these details before booking, to ensure the program is the right fit for their goals. 

  • By enrolling in a Performance program, a participant commits to the Club's standards of play and conduct, helping to ensure a productive environment for every student.

  • Any behaviour that disrupts a session or disregards Club or Academy rules may result in removal from the program without a refund. For the continued integrity of the Club's programs, serious or repeat disruptions may lead to permanent deactivation of the participant's account across all Brands.

 

9. Court Booking Terms

  • To protect the recreational spirit of the Club, courts are strictly for personal use. Unauthorised commercial sessions are prohibited, to ensure the facility remains a space for members rather than outside businesses. Full details are set out in Section 10.3 (Commercial Integrity Policy).

  • To ensure real-time transparency for the Club's membership, all bookings must be made in advance via the Booking System. This prevents the “guesswork” of walk-ins and guarantees that a confirmed slot is secured.

  • The Club User/Hirer must be present for the session. If they cannot make it, they should WhatsApp the Club at +65 8891 2037 to designate a new host who will take over the responsibilities so the session can remain active and accountable. The original Club User/Hirer remains responsible for the entire booking and all guests present, unless confirmed otherwise in writing.

  • The Club User/Hirer is responsible for the well-being and conduct of their guests, and is to ensure all players are familiar with and abiding by the Club's community standards (see also Section 6).

  • Every court booking covers up to 8 players. For everyone's safety, the Club maintains a “4 On-Court, 4 Off-Court” rotation, so players on adjacent courts are not crowded and everyone has a safe space to move. For larger gatherings (8+ players), an additional fee of SGD 10 per person per hour applies. This fee is to be settled before the session begins.

  • Fair Play Timing: the Club runs on a precise schedule so every member gets the full hour they paid for. Please enter only at your booked time and vacate promptly at the end of your session. Even if a court looks empty, please do not use it unless it is explicitly booked. By booking the court, you acknowledge that such usage outside its reserved window (starting early or ending late) will be charged at the full hourly rate, and the Club has the right to charge you directly. Repeat instances may result in suspension or permanent account deactivation at Management's sole discretion.

  • To extend a session, please make the booking in the Booking System at least 5 minutes before the session ends. If this window is missed, members may WhatsApp the Club at +65 8891 2037 and the team will do their best to help if they are available — extensions are subject to court and staff availability and cannot be guaranteed.

  • Cancellation & Rescheduling Policy

    • We understand that plans change, but every empty court is a missed opportunity for another member of our community. To keep our scheduling fair and consistent, we adhere to the following standards, which are also presented prior to booking for easy reference. Please proceed only if you are comfortable and agreeable with the terms.

    • Starter Members: If you are on our Starter Member tier, all bookings are considered final upon confirmation. We encourage you to double-check your schedule before hitting “Book.”

    • The "Pass-It-On" Transfer: Can’t make your session? Don’t let the court go to waste! You can transfer your booking to another member (provided they are within their booking limits). Just WhatsApp us at +65 8891 2037 with the new player’s details, and we’ll handle the rest. This is the best way to ensure the slot is still enjoyed!

    • Community Credits: While we do not offer full refunds, we provide token credits to your account for cancellations made in advance, which can be applied to future sessions:

      • More than 1 week ahead: 20% token credit.

      • More than 72 hours ahead: 10% token credit.

      • Less than 72 hours: No credit available.

    • Fairness for All: We do not make exceptions to these policies. Creating exceptions undermines the fairness of the booking system for the members who organise their lives to play with us. We kindly ask that you do not request exceptions, as our team is dedicated to applying these standards consistently to protect the experience of the entire community.

    • Court Changes (Same Date, Time & Location): If you need to switch to a different court at the same date, time, and location, we will do our best to assist, subject to availability. Please note that cancellations, date shifts, or location changes are not permitted, and we cannot be held responsible if our team's bandwidth does not allow for last-minute modifications.

10. On-Premise Conduct & Club Usage

10.1 Conduct & Etiquette

  • The Club is a community built on mutual respect. All players are expected to display the highest standards of sportsmanship.

  • Rude behaviour, harassment, or intimidation toward staff or fellow members disrupts the environment the community has built together, and will result in suspension or deactivation of the relevant account, and may result in removal from the Premises and/or a report to the relevant authorities where appropriate.

  • We love a lively game, but the Club is part of a larger neighbourhood. After 10:00 PM, noise levels — including shouting and music — must be kept to a minimum to respect our neighbours and ensure we can all continue to enjoy this space long-term.

10.2 Academy & Coaching Sessions

  • To protect the quality of instruction and the safety of our players, only Performance-Certified coaches are permitted to lead sessions within our clubs.

  • Professional Site-Use Fee. Unauthorised commercial coaching (paid or unpaid) is strictly prohibited. Engaging in such activity will result in immediate termination of the booking and a Professional Site-Use Fee of SGD 1,000 (or such higher amount as Management may reasonably determine to reflect the unauthorised commercial use of the facility and associated costs incurred by the Club), followed by permanent deactivation of the relevant account. This fee helps ensure the facility remains dedicated to the Club's certified Academy programs.

  • The use of ball baskets, training aids, or ball machines is not permitted without prior authorisation.

 

10.3 Commercial Integrity Policy

  • Courts and all other Premises are strictly for personal, recreational use only.

  • No use of the Premises for individual or unauthorised conflicting or commercial purposes is permitted — including, but not limited to:

    • Paid or organised social play sessions (including but not limited to Reclub or similar platforms) — Members and guests are strictly prohibited from booking courts for the purpose of organising paid or monetised games, matches, or group sessions. This includes situations where individuals or groups:

      • Collect fees, donations, or “shared costs” from participants to profit or offset booking costs;

      • Advertise, list, or promote their sessions publicly (e.g. on WhatsApp groups, Reclub, PlayTime Scheduler, or social media) to attract players;

      • Represent the session as part of a brand, club, or organized community that is not affiliated with or approved by Management.

    • Paddle or equipment demos, trials, or sales. 

    • Reselling or subletting court bookings at marked-up prices

    • Hosting private games, parties, or events without management approval

    • Conducting or advertising paid coaching, training, or pickleball clinics

    • Filming or creating commercial content (e.g. promotional videos, product endorsements, influencer collaborations)

    • Any other profit-generating, brand-promotional, or business-related activity carried out on-site without prior written consent from Management

  • In short, you may not book a court and then advertise or run it as a paid or semi-commercial event in any capacity. Courts are for personal recreational play only, not to generate income, grow a private following, or operate independently of the club’s programs.

  • All forms of commercial activity on the Premises require explicit written approval from Management. Management has sole discretion in determining whether an activity is commercial, promotional, organised, monetised, business-related, conflicting with Club interests, or otherwise inconsistent with the intended recreational use of the facility.

  • Any attempt to structure, disguise, relabel, facilitate, or indirectly conduct a prohibited commercial activity will be treated as commercial activity for the purposes of this Section.

  • To protect the community from third-party exploitation, any unauthorised commercial activity will result in the immediate and permanent deactivation of the Club User/Hirer's account, in addition to any fee payable and any other enforcement action available.
     

10.4 Facility Care, Damage & Liability

  • To help maintain the Club in excellent condition, outside food and beverages are not permitted on the Premises. Any breach of this rule will incur a Cleaning & Restoration Fee of SGD 100.

  • Food and beverages are permitted only for private or corporate events booked through the Club's official event booking service. Approved events will receive separate F&B guidelines outlining permitted areas, setup requirements, and clean-up responsibilities.

  • All users are expected to leave the premises in a clean and orderly condition. Please remove all personal belongings, dispose of rubbish in the designated bins located outside the premises, and return any furniture or equipment to its original position after use.

  • Where there is no booking immediately following your session, please switch off all lights and fans and ensure all doors are properly secured before departing.

  • Users must not hit balls against walls, fixtures, ceilings, or other parts of the facility, nor engage in any activity that may damage the premises.

  • For safety reasons, any ball that becomes lodged, unretrievable, or comes to rest on a ledge, ceiling, or restricted area must be left untouched. Users must not attempt retrieval by climbing, using equipment, standing on structures, or otherwise bypassing safety measures. Any such attempt constitutes a serious breach of Club rules.

  • Only non-marking court shoes are permitted. Bare feet, sandals, slippers, heels, street shoes, or any unsuitable footwear are strictly prohibited, as they may damage the playing surface.

  • The Club Hirer shall be jointly and severally liable for any damage, excessive cleaning requirements, theft, loss of equipment, unauthorised access, misuse of facilities, breaches of Club rules, or other costs caused by any person attending under their booking. The Club may recover all associated costs, including repair, replacement, restoration, cleaning, administrative, legal, recovery, and enforcement costs, from the Hirer regardless of which individual directly caused the loss or damage.

  • The responsible party shall be liable for all costs arising from such conduct, including but not limited to repair, replacement, restoration, cleaning, administrative, legal, recovery, and enforcement costs, as reasonably determined by Management.
     

10.5 Facility Access

  • Facility access becomes available 10 minutes before your booking. Please refrain from entering earlier, so as not to disrupt the previous session.

  • After entering, please make sure the door is closed for safety.

  • To access the main entrance, open your booking in the app and tap the “Unlock Door” button. This function becomes available 10 minutes before your booking time. If you arrive early, please wait outside the Club until access becomes available.

10.6 Purchases & Rentals

  • The Club operates a trust-based system and greatly appreciates members' honesty and cooperation.

  • Even when the team is not on-site, a selection of drinks, rentals, and convenience items is made available for members' enjoyment. To keep this system running smoothly, please make payment via the PayNow QR code (or other designated payment method) before taking any drinks or renting any equipment.

  • The Club provides high-quality professional paddles for rent to help members get the most out of their sessions. Please make payment before use and we ask that all items be returned promptly after each session, in “match-ready” condition and to its original location so the next group can enjoy the same experience.

  • Paddles experience natural wear and tear during play; however, any damage beyond normal use (e.g., physical impact damage from walls or floors, or improper handling) will incur a repair or replacement fee, as assessed by our team.

10.7 Restricted Zones

  • The basketball court adjacent to the Boathouse is operated independently and is not part of our Club's facility. Please direct all enquiries or bookings for that court to its respective management. Unauthorised entry is considered trespassing by the basketball facility's owners.

  • The Rejuuv recovery area at the Beach Club is a dedicated, private space designed for specialised wellness. Access is exclusive to members with a valid Rejuuv Membership or valid entry pass. To maintain privacy and peace, entry without a valid pass is strictly prohibited. Please ensure you have secured the relevant recovery access before entering this zone.

10.8 Weather Conditions & Rain Policy

  • Nature’s Variables : By booking or entering any Performance Pickleball location, you acknowledge and accept that play may be affected by weather conditions. In the event that courts become unplayable due to rain or other environmental factors, our Rain Policy will apply.

  • The Rain Policy : Because each program (Academy vs court rental vs events etc) has different operational requirements, please refer to the respective program’s FAQ on our website: www.performancepickleball.org.

  • Participation: All play is at your own risk. Performance Pickleball is not liable for accidents or losses occurring on-site. We appreciate your resilience and understanding as we navigate these rare environmental conditions together.

  • Note: The respective rain policies also apply to Performance Pickleball (Boathouse). As stated on our website, while our Boathouse location features an open-sided, 30-metre-high-ceiling design that is approximately 90% weather-resistant and built for excellent ventilation, rare instances of strong wind or heavy rain may cause light rain to enter the courts. Play typically continues without interruption. However, if weather conditions render the courts unplayable, the respective Rain Policy will apply.

 

11. Rejuuv

By booking or using the recovery facilities at Rejuuv (under Umeus), you agree to the following terms:

 

11.1 Health & Safety

  • Use of cold and warm water immersion is entirely at your own risk.

  • Guests with medical conditions (e.g. cardiovascular issues, high/low blood pressure, respiratory concerns), who are pregnant, or feeling unwell should consult a medical professional before using the facility.

  • If at any time you feel dizzy, faint, or unwell, exit immediately and alert a team member.

  • Participants must be 18 years old and above.

11.2 Hygiene & Conduct

  • All users must shower before entering the plunge or bath.

  • Proper swimwear is required at all times. No undergarments or inappropriate attire permitted.

  • Please do not enter if you have open wounds, contagious skin conditions, or any infectious diseases.

  • This is a shared, recovery-focused environment. Loud talking, splashing, or disruptive behaviour is not allowed. Please be mindful of others.

  • No food or alcohol is permitted within the recovery area. Only water is allowed.

11.3 Usage & Booking Terms

  • Each session includes up to 1h of access.

  • Our recovery zones accommodate multiple guests. When capacity is reached, you may need to wait for a spot to open up. Please rotate responsibly.

11.4 Cancellations & Refunds

  • All bookings are non-refundable and non-transferable.

11.5 Liability & Risk Acknowledgement

  • You acknowledge that temperature-based therapies may involve certain physical risks and agree that you are voluntarily participating.

  • Umeus, including Performance Pickleball and Rejuuv, will not be held liable for injuries, accidents, illnesses, or any loss or damage sustained during your use of the recovery facility.

  • Personal belongings brought into the facility are your responsibility. We are not liable for any loss or damage.

11.6 Respect for the Space

  • Please help us keep the space clean, calm, and welcoming for all.

  • Any intentional damage, misuse, or disregard of facility rules may result in suspension, penalty fees, or a permanent ban.

(B) Waiver & Release Agreement

In consideration of being allowed to participate in any way in pickleball activities, programs, or related events at Performance Pickleball, I hereby agree to the following terms:

1. Assumption of Risk

I understand and acknowledge that participation in pickleball and other related sports involves inherent risks, including but not limited to the risk of serious injury, illness, or death.

I accept full responsibility for my own safety and agree to play within my control and abilities at all times. I understand that I am playing entirely at my own risk and that there is no certified first aider on site. I voluntarily assume full responsibility for any and all risks of loss, damage to property, or personal injury (including death) that may arise from my participation at Performance Pickleball.

I further acknowledge that Performance Pickleball is not liable for any injury (including death), loss, or damage sustained while participating in any activity at the facility.

All participants are strongly encouraged to have their own personal accident insurance coverage or sports insurance coverage, which may be used to make any necessary claims in the event of injury, loss, or accident.

 

2. Release of Liability

I hereby release, waive, discharge, and covenant not to sue Performance Pickleball, its owners, employees, agents, volunteers, affiliates, or any other representatives (collectively referred to as “Releasees”) from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, or injury (including death) that may may be sustained by me or any property belonging to me while my being present at and/or participating in any activity at the facility.

This includes, but is not limited to, risks arising from facility conditions, equipment use, weather, other participants’ actions, coaches' actions or staff decisions.

 

3. Indemnification

I agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or cost, including attorney and legal fees, that they may incur due to my participation in any activity or presence at the facility, whether caused by the negligence of the Releasees or otherwise.

 

4. Medical Treatment

I authorise Performance Pickleball and its staff to arrange or provide appropriate medical treatment in the event of injury or illness while I am participating in any activity at the facility. I understand and accept that I am responsible for any medical costs incurred.

 

5. Photographic & Video Release

By entering or participating in any activities at Performance Pickleball, you grant Umeus the right to capture and use photographs and/or video footage of you for marketing and promotional purposes. This includes, but is not limited to, usage on social media, websites, print materials, and advertisements. This includes footage captured through our Smart Court camera systems and any other recording devices used at our venues. No compensation will be provided for the use of such media. By participating, you acknowledge and agree to this media release policy.

 

6. Voluntary Participation

I confirm that my participation is completely voluntary. I acknowledge that I have read, understood, and agree to all the terms within this agreement. I understand that I may consult independent legal advice prior to agreeing to these terms if I so desire.

 

7. Governing Law

This agreement shall be governed by and construed in accordance with the laws of Singapore, without giving effect to any principles of conflicts of law.

 

8. Severability

If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

 

Right of Refusal

Performance Pickleball reserves the right to refuse, cancel, or terminate any court booking, lesson, program, or event at its sole discretion—particularly if the booking violates our terms, poses a safety risk, or disrupts the operation of the facility. No liability will be assumed for such cancellations.

 

​Governing Law & Jurisdiction

These terms and conditions shall be governed by the laws of Singapore. Any dispute arising out of or relating to these terms shall fall under the exclusive jurisdiction of the Singapore courts.​

(C) Privacy Policy

Effective Date: January 1, 2025

1. Introduction

Welcome to Umeus. Your privacy is important to us. This Privacy Policy outlines how we collect, use, share, and protect your personal information when you interact with our services, website, and applications. If you have any questions or concerns, please contact us at: support@umeusgroup.com.

 

2. Information We Collect

We collect personal data that you voluntarily provide when you:

  • Create an account or sign up for a service

  • Book courts, participate in programs or tournaments, or purchase products

  • Subscribe to newsletters or marketing communications

  • Contact us via email, phone, or through our website

Types of Information Collected:

  • Personal Information: Full name, email address, phone number, and mailing address

  • Account Information: Username, password, and user preferences

  • Transaction Information: Booking history, payments, and order details (processed via secure third-party payment platforms)

  • Communications: Emails, inquiries, feedback, or customer service correspondence

 

3. How We Use Your Information

We use your personal data to:

  • Manage bookings, memberships, and event participation

  • Process payments and send booking or purchase confirmations

  • Communicate updates, promotions, or service-related notifications (if opted in)

  • Respond to inquiries and provide support

  • Improve our programs, services, and user experience

  • Fulfil legal, regulatory, or contractual obligations

 

4. Sharing Your Information

We do not sell your personal information. We may share your data with trusted third parties under the following circumstances:

  • Service Providers: To assist with operations such as payment processing, booking systems, communication platforms, and IT services

  • Legal Authorities: If required by law, regulation, legal process, or court order

  • Business Transfers: In the event of a merger, acquisition, or organisational restructuring

All third-party service providers are contractually required to protect your data and maintain confidentiality.

 

5. How We Protect Your Information

We implement appropriate security measures—technical and organisational—to safeguard your personal data against loss, theft, unauthorised access, or disclosure.

However, no method of internet transmission or digital storage is completely secure. By using our services, you acknowledge and accept this risk.

 

6. Your Privacy Rights

Depending on your jurisdiction, you may have the right to:

  • Access the personal information we hold about you

  • Correct any inaccuracies in your personal information

  • Request deletion of your data from our systems

  • Withdraw consent from marketing communications at any time

7. Changes to This Privacy Policy

  • You and all your guests agree to comply fully with all club policies, safety rules, and participation requirements.

  • Performance Pickleball reserves the right to amend this agreement at any time without prior notice. The most updated version will always be available via our website and booking platform.
