MEMBERSHIP AGREEMENT

(A) Club & Membership Terms and Conditions
​
1. Acceptance of Terms
By booking a court, event, lesson, program, session, or workshop with Performance Group, you agree to abide by the following terms and conditions in full. These terms are binding upon the individual or entity making the reservation and all associated participants. Any breach of these terms will result in immediate suspension and a permanent ban from all Performance Group facilities, programs, events and associated brands.
2. Usage Responsibility

Club usage is the sole responsibility of the individual or entity making the reservation (referred to as the “Club User/Hirer”). The Club User/Hirer must ensure that all participants have an active membership, are fully aware and comply with these membership rules and agreement and check in at the front desk with their membership code before entering and using our premises.

If any individual is not agreeable to these terms, they should refrain from agreeing to this agreement, entering the club or participating in any activities.

Any person who refuses to create an account or check in will be denied entry, and play will not be permitted.
-
Any person who makes any booking, enters the club without checking in, or checks in using a false identity, another person’s account, or a duplicate account etc will be considered in breach of our agreement. In such cases, both the offending player and the responsible Club User/Hirer will face immediate suspension and a permanent ban from all Performance Group clubs, facilities, programs, and events.

Additionally, if any individual enters or participates without having signed the official waiver, the Club User/Hirer acknowledges and agrees that it shall be deemed that the individual has read, understood, and consented to the waiver and all related terms on their behalf.

Club usage outside of official Performance Pickleball programs are for personal recreational use only. Any conflicting, commercial, or paid sessions (including through Reclub or similar platforms) are strictly prohibited. Please refer to the Club Rules & Usage Guidelines for the full policy.

This agreement exists to maintain a safe, fair, and accountable environment for everyone. All players and the Court Hirer are responsible for their conduct while on the premises. Individuals who breach any terms outlined in this membership agreement or behave in a way that undermines the experience of others will face immediate suspension and permanent ban of both the Club User/Hirer and any offending participants from all Performance Group facilities, programs, events, and associated brands. If you do not intend to follow our rules, please play elsewhere — Performance Group is committed to protecting our community and space.

3. Membership Requirements
Performance Group is a private, members-only club. Every user must have an active membership to enter or use any part of our facilities—including the courts, lounge, waiting areas, recovery zones etc.

Signing up is quick and easy via the Performance Pickleball app.

We also have a free membership tier.
-
Membership helps us maintain accountability, safety, and ensures all players are aware and comply with the membership rules and agreement.

It is the Club User/Hirer responsibility to ensure all players under their booking have a valid membership before their session, have agreed and complies to our membership rules and agreement. For more information, refer to Clause 2.

3.1 Membership Check-In
-
All players must scan their membership QR code at the front desk before entering and using any of our facilities.
-
No membership = no entry. For more information, refer to Clause 2.
​
3.2 Junior Players
-
Children under 18 may enter without their own membership account, provided they are accompanied by the booking adult.
-
That adult is fully responsible for the child's behaviour and safety. Children will be tagged under the adult’s account for accountability.
​
4. Program Booking Terms​​
-
An active membership is required to participate in any program, lesson, clinic, workshop, program, or recovery session etc.
-
Advance booking is mandatory; walk-ins are strictly not permitted under any circumstances.
-
Each program has its own registration process, terms and conditions, and cancellation policies. Full details can be found on the respective program pages on our website or within the booking page.

Before participating, you are required to read and familiarise yourself with all rules, requirements, terms and conditions, cancellation policies, and other relevant information, which can be found on the booking page and/or program FAQ on our website.

By participating in and paying for a program, you are deemed to have read, understood, and agreed to all applicable terms and conditions.
-
Failure to meet program requirements or comply with rules, or engaging in behaviour that disrupts the session for others or the coaches may result in removal from the session without a refund. Additional penalties may apply, including a permanent ban from all Performance Group programs, facilities, events and associated brands.
5. Court Booking Rules

5.1 Court Use

Courts are for personal recreational use only. Conflicting, commercial or paid sessions (including Reclub or similar platforms) are strictly prohibited. See Club Rules & Usage Guidelines for full policy.

Courts are bookable as per app schedule. To check real-time availability and book your slot, use our app to book in advance. No walk-ins allowed.
-
The Club User/Hirer agrees to all membership and booking rules and rates and strict adherence to the allocated booking time. Any court usage outside of the booked time will be charged at the full hourly rate of the unbooked slot.

The Cancellation Policy is as stated on the Performance Pickleball app prior to court booking confirmation, and in the Court Booking FAQ section on our website.

Failure to comply with the rules, or engaging in behaviour that disrupts the session for other club users or coaches, may result in removal from the session without a refund. Additional penalties may apply, including a permanent ban from all Performance Group programs and facilities for both the court hirer and any offending participants.

Any person who makes any booking, enters the club without checking in, or checks in using a false identity, another person’s account, or a duplicate account etc will be considered in breach of our agreement. In such cases, both the offending player and the responsible Club User/Hirer will face immediate suspension and a permanent ban from all Performance Group clubs, facilities, programs, and events.

Any booking made using a false identity, another person’s account, or through duplicate accounts is a breach of our Club Agreement. In such cases, both the offending player and the responsible Club User/Hirer will face immediate suspension and a permanent ban from all Performance Group clubs, facilities, programs, and events. The booking will be cancelled with no refund. By making a booking, the Court Hirer confirms that they are using their own account, respecting individual booking limits, and honouring all Club Rules, and agrees to be subject to these penalties.

Before booking a court and attending your session, you must read and familiarise yourself with all rules, requirements, terms and conditions, cancellation policies, and other relevant information.

5.2 Booking Responsibilities
-
Court usage is the sole responsibility of the individual or entity making the reservation (referred to as the “Club User/Hirer”).

The Club User/Hirer must ensure that all participants have an active membership, are fully aware of our membership rules and agreement, comply with all club rules, safety policies, and membership requirements and have checked in at the front desk before entering and using the club.

The Court Hirer must be present during the entire session and is responsible for all players under their booking.
-
If the original Court Hirer is unable to attend, please notify us immediately (WhatsApp +65 88912037) with the new designated court booker so that we can update the booking with a new designated person, who will then assume full responsibility for the session and all participants.

Any breach of rules or agreement will be attributed to the Court Hirer, who is accountable for all guests under their booking. Both the Court Hirer and any offending participants will face immediate suspension and a permanent ban from all Performance Group clubs, facilities, programs, and events.

5.3 Player Limits

Each court booking covers up to 8 players/court
-
For the safety of all players and those on adjacent courts, only 4 players are permitted on-court and actively playing at any given time.
-
Additional players must remain in the court-side seating area, designated waiting area, or lounge.
-
For bookings with more than 8 players, an additional fee of $10 per person per hour applies. This fee can be paid during booking or upon check-in.
-
Please ensure that payment is made before the session begins. Our team truly appreciates your cooperation — it helps us maintain a smooth experience for everyone and saves our staff from having to chase for payment.

5.4 Respect Booking Times:

While we may occasionally open the facility early as a courtesy, please treat this as a privilege, not an expectation. Do not attempt to open locked doors or enter through unauthorised areas.

Entry to the courts is permitted only during your booked time. Members must vacate the courts promptly at the end of their session, even if no one is scheduled immediately before or after.

Courts that appear unoccupied are not available for use unless they are explicitly booked. Strictly no walk-ins are allowed.

Any individual found using the courts without a valid booking, or playing outside of their reserved time (e.g., starting early or ending late), will receive a formal warning and be charged the full hourly rate.

Repeat offences (two or more) will result in a permanent ban from the club and all Performance Group facilities.
-
These rules exist to maintain fairness and respect for all players and court bookers. Our club values honesty, integrity, and fairness — and we warmly welcome those who share these principles. Individuals who attempt to bend the rules or take advantage of the system will not be tolerated.

6. Club Rules & Usage Guidelines

6.1 Conduct & Etiquette
All players are expected to uphold a high standard of conduct while on the premises. Performance Group strives to create a welcoming, respectful, and enjoyable environment for everyone.

Respect for staff and members: Any form of rudeness, verbal abuse, harassment, intimidation, or disrespectful behaviour toward staff, coaches, or fellow members will result in immediate suspension or a permanent ban.

Responsibility of the Court Hirer: The Court Hirer is responsible for ensuring that all guests under their booking behave respectfully and comply with all club rules and policies. Misconduct by guests will be treated as a breach by the Court Hirer.

Fair play and etiquette: Players should display good sportsmanship at all times — including proper rotation, sharing of courts, and adhering to booked timings.
-
Cleanliness and respect for facilities: Please help keep the courts and common areas clean and tidy. Dispose of litter responsibly and return any borrowed equipment.
-
Noise and disruption: Excessive shouting, music, or behaviour that disrupts others is not permitted.

6.2 Coaching Policy
Performance Group is committed to maintaining the quality and integrity of all coaching conducted within our space. To ensure safety, consistency, and professionalism:

Unauthorised coaching is strictly prohibited. Outside coaching, paid or unpaid, is not allowed unless explicitly pre-approved by management.
-
The use of ball baskets, training aids, or ball machines is also not permitted without prior authorisation.
-
Violations will result in immediate termination of the court booking without refund, a penalty fee of $1000 and a permanent ban of all offending players from all Performance Group facilities, programs and events.
-
These policies protect the safety of players, ensure fair facility usage, and preserve the professional standard of coaching within the club.
-
If you would like to receive lessons or improve your game, please book a certified Performance Pickleball coach through our official channels.

6.3 Commercial Use Policy
-
Courts are strictly for personal, recreational use only.
-
No use of courts for individual or unauthorised conflicting or commercial purposes is permitted — including but not limited to:
-
Paid or organised social play sessions (including but not limited to Reclub or similar platforms) — Members and guests are strictly prohibited from booking courts for the purpose of organising paid or monetised games, matches, or group sessions. This includes situations where individuals or groups:
-
Collect fees, donations, or “shared costs” from participants to profit or offset booking costs;
-
Advertise, list, or promote their sessions publicly (e.g. on WhatsApp groups, Reclub, PlayTime Scheduler, or social media) to attract players;
-
Represent the session as part of a brand, club, or organized community that is not affiliated with or approved by Management.
-
In short, you may not book a court and then advertise or run it as a paid or semi-commercial event in any capacity. Courts are for personal recreational play only, not to generate income, grow a private following, or operate independently of the club’s programs.
-
Paddle or equipment demos, trials, or sales.
-
Reselling or subletting court bookings at marked-up prices
-
Hosting private games, parties, or events without management approval
-
Conducting or advertising paid coaching, training, or pickleball clinics
-
Filming or creating commercial content (e.g. promotional videos, product endorsements, influencer collaborations)
-
Any other profit-generating, brand-promotional, or business-related activity carried out on-site without prior written consent from Management
-
All forms of commercial activity on the premises must have explicit written approval from Management.
-
If such activities are discovered, the booking party will be immediately banned from all our venues and will no longer be permitted to book or enter any of our clubs or partner locations.

6.4 Noise Policy
We love an energetic atmosphere—but please be mindful of our surroundings and community.
-
Performance Pickleball (Boathouse) is located close to residential buildings. As such, noise levels must be kept low after 10:00 PM.
-
Loud music, shouting, and disruptive behaviour are strictly prohibited at all times.
-
Staff reserve the right to request volume reduction or remove individuals who disregard repeated warnings.
-
Let’s keep the vibe lively, fun, and respectful so everyone—players and neighbours alike—can enjoy the space.

6.5 Food & Beverage Policy
To protect our courts, maintain hygiene, and ensure a clean, professional environment for all users:

Outside food and beverages are strictly prohibited for all regular court bookings, except for plain water and 100 Plus Zero.
-
Non-compliance will result in a $100 fine, immediate suspension, and potential permanent ban from all Performance Group facilities, events, programs etc.
-
Any damage or stains to courts, nets, or furniture caused by outside food and drink will be chargeable to the responsible party.
-
Food and beverage are only permitted for private or corporate events, which must be booked through our official event booking service.
-
Approved events will receive separate F&B guidelines outlining permitted areas, setups, and clean-up responsibilities.

6.5 Equipment Rentals
-
We offer high-quality rental equipment to enhance your session, whether it’s a court booking or program booking. Full details and pricing are available on our website.
-
For convenience, rentals can be added during the court booking process. If you forget to add it in advance, our staff will be happy to assist you on-site, subject to availability.
-
Return Policy: Equipment must be returned in good condition. Lost balls (including those stuck / hit onto the ledge or ceiling) are charged at $2 each. Damaged paddles beyond normal wear will incur repair or replacement fees as assessed by staff.

6.6 Court & Footwear Regulations
-
Strictly no hitting balls against any walls.
-
For your safety and in accordance with our facility regulations, please note the following:
-
Any balls hit onto the ledge on either court at Boathouse,
-
Any balls stuck on the ledge at Beach Club, or
-
Any balls that are unretrievable in any part of the court
-
-
are considered strictly non-retrievable for everyone, including guests and staff. These rules are in place due to important safety requirements. Unless a ball naturally falls back down on its own, please do not attempt to retrieve it. Any person seen attempting to retrieve a ball—using sticks, climbing, stepping onto structures, or by any other means—will face a fine and a ban, as this is considered a serious safety violation. Dangerous actions may also be reported to the police.

All players must wear proper non-marking court shoes. Sandals, FitFlops, or any non-sports footwear are strictly prohibited for safety reasons. Our courts are professionally surfaced and require appropriate footwear to maintain their quality and prevent damage. We understand that some players may not have such shoes; however, all footwear must not leave marks, scuff, or stain the court. If shoes are found to be causing damage, players must stop play immediately to prevent further harm. Any damage caused to the courts due to improper footwear will be chargeable to the responsible party.

6.7 Basketball Court / Recovery Area Policy

The basketball court next to our courts at Boathouse is not part of our facility.
-
The recovery area at Beach Club is a 100% private space and requires its own membership, entry pass, and applicable fees.
-
Use of either space requires a separate booking made directly with the respective operators.
-
Unauthorised entry or use of the basketball court will be treated as trespassing and will be handled by the basketball court owners.
-
Unauthorised entry into the recovery area without a valid membership or entry pass will be treated as trespassing, and may result in a $500 fine and a ban.

6.8 Speaker System Policy
-
The speaker system is reserved exclusively for staff use to ensure a consistent environment.
-
No personal device connections to the speakers are allowed.
-
Exceptions are made for corporate or private events that have pre-booked speaker and microphone rentals.​
​
6.9 Weather Conditions & Rain Policy
-
By booking or entering any Performance Pickleball location, you acknowledge and accept that play may be affected by weather conditions. In the event that courts become unplayable due to rain or other environmental factors, our Rain Policy will apply.
-
The Rain Policy varies based on the type of booking (e.g. court rental, lesson, event) and is outlined in the respective program’s FAQ on our website: www.performancepickleball.org.

All players participate at their own risk. Performance Pickleball is not liable for any injuries, accidents, or losses that may occur on the premises
-
Note: The respective rain policies also apply to Performance Pickleball (Boathouse). As stated on our website, while our Boathouse location features an open-sided, 30-metre-high-ceiling design that is approximately 90% weather-resistant and built for excellent ventilation, rare instances of strong wind or heavy rain may cause light rain to enter the courts. Play typically continues without interruption. However, if weather conditions render the courts unplayable, the respective Rain Policy will apply. Please refer to the relevant program’s FAQ for full details.

6.10 Cancellation & Rescheduling Policy
The Cancellation Policy is clearly displayed on the Performance Pickleball App before booking confirmation, and can also be found under the Court Booking FAQ section on our website. Please read the policy carefully before confirming your booking. Proceed only if you are fully comfortable and agreeable with the terms below.

For Starter Members : We’re thrilled to have you on court — but once a booking is made, it’s considered final. As a Starter Member, please note that all court and program bookings are non-cancellable and non-reschedulable, so double-check your details before hitting “Book”!
-
If You Can’t Make It : No worries — you can transfer your booking to another member as long as that member has not reached his/her daily and weekly limits! Simply WhatsApp us at +65 8891 2037 with the booking details, new player’s full name and membership email, and we’ll update the booking for you. This is the best way to ensure your slot is still enjoyed and doesn’t go to waste.

Last Resort, Cancelling : We understand that plans change. While we can’t offer a full refund, we may offer a small token refund to your account credits, depending on when you cancel:

More than 1 week in advance – Up to 20% refund
-
More than 72 hours in advance – Up to 10% refund
-
Less than 72 hours – No refund, sorry! :(

No exceptions will be made to ensure fairness and consistency for all members. We kindly ask that you do not request exceptions, as this creates inconsistency and added difficulty for our team. Thank you for understanding and helping us keep things fair for everyone.
Changing Courts (Same Date, Time & Location Only)

Need to switch courts but keeping the same date, time, and location? We’ll do our best to assist — but this is subject to court availability and our team’s bandwidth at the time of your request.

To avoid disappointment:

Please make these requests well in advance.

We may not be able to accommodate last-minute changes.
-
Performance Pickleball cannot be held responsible if we’re unable to process your request.

This flexibility applies only to court changes within the same date, time, and location.

Requests involving cancellations, time changes, date changes, or location changes are not permitted, in accordance with our policy.

7. Shop Hours & Purchases
Our shop at Boathouse is open during staff operating hours, which generally align with scheduled court bookings, programs, or events.

If you’re planning to visit for in-store purchases, paddle demos, or gear pickups, we require you to text us at +65 8891 2037 ahead of time to confirm staff availability.

For maximum convenience, you can browse and shop online anytime via our website.

Popular products include: paddles, balls, apparel, grips, and other accessories—perfect for both casual players and pickleball enthusiasts.

8. Performance Recovery
By booking or using the Recovery facilities at Performance Recovery (under Performance Group), you agree to the following terms:

8.1 Health & Safety
-
Use of cold and warm water immersion is entirely at your own risk.
-
Guests with medical conditions (e.g. cardiovascular issues, high/low blood pressure, respiratory concerns), who are pregnant, or feeling unwell should consult a medical professional before using the facility.
-
If at any time you feel dizzy, faint, or unwell, exit immediately and alert a team member.
-
Participants must be 18 years old and above.
​
8.2 Hygiene & Conduct
-
All users must shower before entering the plunge or bath.
-
Proper swimwear is required at all times. No undergarments or inappropriate attire permitted.
-
Please do not enter if you have open wounds, contagious skin conditions, or any infectious diseases.
-
This is a shared, recovery-focused environment. Loud talking, splashing, or disruptive behaviour is not allowed. Please be mindful of others.
-
No food or alcohol is permitted within the recovery area. Only water is allowed.
8.3 Usage & Booking Terms
-
Each session includes up to 1h of access.
-
Our recovery zones accommodate multiple guests. When capacity is reached, you may need to wait for a spot to open up. Please rotate responsibly.

8.4 Cancellations & Refunds
-
All bookings are non-refundable and non-transferable.
​
8.5 Liability & Risk Acknowledgement
-
You acknowledge that temperature-based therapies may involve certain physical risks and agree that you are voluntarily participating.
-
Performance Group, including Performance Recovery, will not be held liable for injuries, accidents, illnesses, or any loss or damage sustained during your use of the recovery facility.
-
Personal belongings brought into the facility are your responsibility. We are not liable for any loss or damage.
​
8.6 Respect for the Space
-
Please help us keep the space clean, calm, and welcoming for all.
-
Any intentional damage, misuse, or disregard of facility rules may result in suspension, penalty fees, or a permanent ban.

(B) Waiver & Release Agreement
In consideration of being allowed to participate in any way in pickleball activities, programs, or related events at Performance Pickleball, I hereby agree to the following terms:
​
1. Assumption of Risk
I understand and acknowledge that participation in pickleball and other related sports involves inherent risks, including but not limited to the risk of serious injury, illness, or death.
​
I accept full responsibility for my own safety and agree to play within my control and abilities at all times. I understand that I am playing entirely at my own risk and that there is no certified first aider on site. I voluntarily assume full responsibility for any and all risks of loss, damage to property, or personal injury (including death) that may arise from my participation at Performance Pickleball.
​
I further acknowledge that Performance Pickleball is not liable for any injury (including death), loss, or damage sustained while participating in any activity at the facility.
​
All participants are strongly encouraged to have their own personal accident insurance coverage or sports insurance coverage, which may be used to make any necessary claims in the event of injury, loss, or accident.
​
2. Release of Liability
I hereby release, waive, discharge, and covenant not to sue Performance Pickleball, its owners, employees, agents, volunteers, affiliates, or any other representatives (collectively referred to as “Releasees”) from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, or injury (including death) that may may be sustained by me or any property belonging to me while my being present at and/or participating in any activity at the facility.

This includes, but is not limited to, risks arising from facility conditions, equipment use, weather, other participants’ actions, coaches' actions or staff decisions.
​
3. Indemnification
I agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or cost, including attorney and legal fees, that they may incur due to my participation in any activity or presence at the facility, whether caused by the negligence of the Releasees or otherwise.
4. Medical Treatment
I authorise Performance Pickleball and its staff to arrange or provide appropriate medical treatment in the event of injury or illness while I am participating in any activity at the facility. I understand and accept that I am responsible for any medical costs incurred.

5. Photographic & Video Release
By entering or participating in any activities at Performance Group, you grant Performance Group the right to capture and use photographs and/or video footage of you for marketing and promotional purposes. This includes, but is not limited to, usage on social media, websites, print materials, and advertisements. This includes footage captured through our Smart Court camera systems and any other recording devices used at our venues. No compensation will be provided for the use of such media. By participating, you acknowledge and agree to this media release policy.
6. Voluntary Participation
I confirm that my participation is completely voluntary. I acknowledge that I have read, understood, and agree to all the terms within this agreement. I understand that I may consult independent legal advice prior to agreeing to these terms if I so desire.
7. Governing Law
This agreement shall be governed by and construed in accordance with the laws of Singapore, without giving effect to any principles of conflicts of law.
8. Severability
If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
Right of Refusal
Performance Pickleball reserves the right to refuse, cancel, or terminate any court booking, lesson, program, or event at its sole discretion—particularly if the booking violates our terms, poses a safety risk, or disrupts the operation of the facility. No liability will be assumed for such cancellations.

Governing Law & Jurisdiction
These terms and conditions shall be governed by the laws of Singapore. Any dispute arising out of or relating to these terms shall fall under the exclusive jurisdiction of the Singapore courts.​
